Terms Of Service
Menolae — Terms of Service
Last Updated: March 2026
Introduction & Overview
Welcome to Menolae. The terms "we", "us", and "our" refer to Menolae, a brand operated by a company registered in the United Kingdom. We operate this online store and website, including all related information, content, features, tools, products, and services (collectively, the "Services"), to provide you with a premium shopping experience.
Our Services are powered by Shopify, which provides the e-commerce infrastructure that enables us to serve you.
These Terms of Service (the "Terms"), together with all policies referenced herein — including our Privacy Policy, Shipping Policy, and Refund & Returns Policy — govern your access to and use of our Services. Please read these Terms carefully. They contain important information about your legal rights and responsibilities, including warranty provisions and limitations of liability.
By visiting, browsing, or using our Services in any way, or by placing an order, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use our Services.
Where you are a consumer located in Australia, nothing in these Terms limits, excludes, or modifies any right or remedy you are entitled to under the Australian Consumer Law (ACL), as contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth), to the extent that such limitation, exclusion, or modification is unlawful.
Section 1 — Access & Account
By agreeing to these Terms, you represent and warrant that:
- You are at least the age of majority in your jurisdiction of residence;
- Where applicable, you have obtained appropriate parental or guardian consent for any minor dependents to use the Services on devices you own or manage;
- All information you provide to us is accurate, current, and complete, and you hold all rights necessary to provide such information.
You are solely responsible for maintaining the confidentiality and security of your account credentials and for all activity that occurs under your account. You may not transfer, sell, assign, or otherwise deal with your account to any third party without our prior written consent. We reserve the right to suspend or terminate any account that we reasonably believe has been compromised or used in breach of these Terms.
Section 2 — Our Products
We make every reasonable effort to accurately describe and represent our products on our website. However, you acknowledge that:
- Colours, textures, and product appearances may vary from what is displayed on your device due to individual screen settings, display technology, and device configurations;
- We do not warrant that the appearance or quality of any product will exactly match on-screen representations;
- Product descriptions, specifications, and availability are subject to change at any time without prior notice, at our sole discretion;
- We reserve the right to discontinue any product or limit purchase quantities available to any individual, geographic region, or jurisdiction at any time.
Your purchase of any product constitutes your acceptance of these representations.
Section 3 — Orders
When you submit an order through our Services, you are making a formal offer to purchase. Menolae reserves the right to accept or decline any order at its sole discretion, for any reason, including but not limited to product availability, pricing errors, or suspected fraudulent activity.
An order is not accepted, and no binding contract is formed, until we issue a written order confirmation to the email address provided at checkout. Payment must be received and processed before an order is accepted.
You are responsible for reviewing your order carefully before submission. Once an order is accepted, we may be unable to accommodate cancellation or modification requests. If we are unable to accept, modify, or must cancel your order for any reason, we will notify you using the contact details provided and arrange a full refund of any payment received.
Your purchases are subject to return or exchange solely in accordance with our Refund, Returns & Warranty Policy. You represent and warrant that all purchases are for your personal or household use only and not for commercial resale, export, or redistribution.
Section 4 — Prices & Billing
All prices displayed on our website are subject to change without prior notice. The price applicable to your order is the price confirmed in your order confirmation email at the time of acceptance.
Unless expressly stated otherwise, displayed prices exclude applicable taxes, shipping costs, customs duties, and import charges. These additional costs, where applicable, will be clearly displayed at checkout or, in the case of customs duties, are the responsibility of the recipient in accordance with applicable laws.
We may, from time to time, offer promotions or discounts governed by separate terms. Where a conflict exists between promotional terms and these Terms, the promotional terms shall prevail for the duration of that promotion.
You represent and warrant that:
- All payment information you provide is accurate, complete, and current;
- You are duly authorised to use the payment method provided;
- All charges incurred will be honoured by your financial institution;
- You will promptly update your payment and billing details to ensure uninterrupted service.
We reserve the right to cancel any order where we reasonably suspect payment fraud, unauthorised use of payment credentials, or misrepresentation.
Section 5 — Shipping & Delivery
Delivery timeframes provided on our website and at checkout are estimates only and are not guaranteed. We are not liable for delays caused by carriers, customs authorities, weather events, industrial action, or any other circumstances beyond our reasonable control.
Risk of loss and title in goods transfers to you at the point we hand the order to the carrier. Carrier tracking confirmation constitutes valid proof of dispatch. Once a parcel has been confirmed as dispatched by the carrier, Menolae is not liable for subsequent loss, theft, misdelivery, or damage caused by the carrier or third parties.
You are solely responsible for providing a complete, accurate, and accessible delivery address at the time of order. Menolae accepts no liability for delays, failed deliveries, or losses arising from an incorrect or incomplete address provided by you. Address changes after order acceptance cannot be guaranteed.
Customs duties, import taxes, and any related charges are the sole responsibility of the recipient. Menolae does not pre-pay customs obligations on your behalf. Refused or abandoned shipments will be handled in accordance with our Refund, Returns & Warranty Policy.
For full details on shipping, tracking, and delivery, please refer to our Shipping Policy.
Section 6 — Intellectual Property
All content, materials, and technology forming part of our Services — including but not limited to trademarks, logos, trade names, text, graphics, images, product photography, video, audio, software, and the selection and arrangement thereof — are the property of Menolae, its affiliates, or its licensors, and are protected by applicable United Kingdom, Australian, and international intellectual property laws.
These Terms permit you to access and use our Services for personal, non-commercial purposes only. You must not, without our prior written consent:
- Reproduce, copy, download, or distribute any content from our Services;
- Modify, create derivative works from, or commercially exploit any material;
- Remove, alter, or obscure any intellectual property notice or identifier;
- Use our trademarks, brand names, logos, or product names in any manner not expressly authorised.
Shopify and its associated names, logos, and trademarks are the property of Shopify Inc. All other third-party names and marks appearing on our Services are the property of their respective owners.
Unauthorised use of our intellectual property may constitute a violation of applicable copyright, trademark, and other laws and may give rise to civil or criminal liability.
Section 7 — Third-Party Tools & Services
We may provide access to optional tools, applications, or integrations operated by third parties as part of our Services. Such tools are provided "as is" and "as available" without any warranty, representation, or endorsement by Menolae. We have no control over and accept no responsibility for third-party tools or platforms.
Your use of any optional third-party tool is entirely at your own risk. You are responsible for reviewing and understanding the terms and privacy policies of any third-party provider before use.
We may, at any time, introduce new features, tools, or integrations into our Services. All such additions shall be subject to these Terms upon release.
Section 8 — Third-Party Links
Our Services may contain hyperlinks or references to third-party websites or content. Such links are provided for convenience only and do not constitute an endorsement or recommendation by Menolae of the third-party website or its content.
We have no control over and accept no responsibility for the content, accuracy, legality, or practices of any third-party website. If you choose to leave our Services to access a third-party site, you do so entirely at your own risk. Any transactions or interactions you engage in with third parties are solely between you and that third party.
Section 9 — Relationship with Shopify
Our Services are built and operated on the Shopify e-commerce platform. Shopify provides the technical infrastructure, payment processing, and hosting that enable us to operate our online store. However, all sales, orders, and customer relationships are between you and Menolae directly. Shopify is not a party to any transaction between you and Menolae.
Shopify bears no responsibility for product quality, delivery, refunds, warranties, or customer service matters. By using our Services, you expressly acknowledge and agree that Shopify and its affiliates are released from any claims, liabilities, or obligations arising from your purchase or use of our Services.
Section 10 — Privacy & Data Protection
All personal information collected through our Services is handled in accordance with our Privacy Policy, available on our website. By using our Services, you acknowledge and agree to the terms of our Privacy Policy.
Menolae is operated by a company registered in the United Kingdom. Our Services are hosted on Shopify, which acts as a data processor on our behalf. Personal information — including your name, address, payment details, and browsing behaviour — may be processed by Shopify solely for the purposes of operating the store, processing transactions, and maintaining platform security.
Personal information may be transferred to and processed in countries other than your country of residence, including the United Kingdom and jurisdictions where Shopify's infrastructure is located. Appropriate safeguards are applied in compliance with applicable data protection laws, including the UK GDPR and, where applicable, the Australian Privacy Act 1988 (Cth).
We do not sell, rent, or trade your personal data to third parties for marketing purposes. Personal information may be used for order fulfilment, customer support, fraud prevention, and marketing communications where you have provided consent or where otherwise permitted by law.
For full details, please refer to our Privacy Policy or contact us at support@menolae.com.
Section 11 — User Feedback & Reviews
By submitting, uploading, or transmitting any ideas, suggestions, feedback, reviews, or other content (collectively, "Feedback") to us through any channel, you grant Menolae a perpetual, worldwide, royalty-free, sublicensable licence to use, reproduce, modify, adapt, publish, distribute, and display such Feedback for any purpose, including operating, improving, and promoting our Services.
You represent and warrant that:
- You own or hold all necessary rights to the Feedback you submit;
- You have disclosed any compensation, incentives, or conflicts of interest relating to your Feedback;
- Your Feedback does not infringe any third-party rights or violate any applicable law.
We are under no obligation to maintain Feedback in confidence, compensate you for Feedback, or publish or use any Feedback submitted. We reserve the right to remove any Feedback that we determine, in our sole discretion, to be unlawful, offensive, defamatory, or otherwise objectionable.
Section 12 — Errors, Inaccuracies & Omissions
Despite our best efforts, our Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, availability, or delivery timeframes. We reserve the right to correct any such errors and to cancel or modify orders affected by pricing or listing errors, at any time and without prior notice — including after an order has been submitted.
We will notify affected customers promptly and arrange a full refund where an order is cancelled due to an error on our part.
Section 13 — Prohibited Uses
You agree to access and use our Services for lawful purposes only. You must not:
- Use our Services for any unlawful, fraudulent, or malicious purpose;
- Violate any applicable local, national, or international law or regulation;
- Infringe the intellectual property rights of Menolae or any third party;
- Harass, abuse, threaten, or harm any individual through use of our Services;
- Transmit false, misleading, or deceptive information;
- Upload or transmit viruses, malware, or any code designed to impair our Services;
- Attempt to gain unauthorised access to any part of our Services or related systems;
- Scrape, harvest, or collect personal data from our Services without authorisation;
- Use our Services to send unsolicited communications or spam;
- Reproduce, resell, or commercially exploit any part of our Services without our express written consent.
We reserve the right to suspend, disable, or permanently terminate your access to our Services at any time, without notice, if we determine that you have violated any of these Terms or engaged in conduct that is harmful to Menolae, our customers, or third parties.
Section 14 — Termination
We may terminate or suspend your access to our Services, in whole or in part, at any time and without notice, for any reason at our sole discretion, including a breach of these Terms. Upon termination, you remain liable for all amounts owing up to and including the date of termination.
The following provisions survive termination of these Terms: Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Dispute Resolution, Governing Law, Privacy Policy, and all other provisions that by their nature are intended to survive.
Section 15 — Disclaimer of Warranties
To the fullest extent permitted by applicable law, our Services and all products offered through them are provided "as is" and "as available", without any representation, warranty, or condition of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, or non-infringement.
We do not warrant that our Services will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We do not warrant that defects will be corrected or that our Services will meet your specific requirements.
Important — Australian Consumers: Nothing in this section is intended to exclude, restrict, or modify any consumer guarantee, warranty, or right that cannot lawfully be excluded under the Australian Consumer Law or any other applicable statute. To the extent any implied warranty or condition cannot be excluded, our liability is limited to the extent permitted by law.
Section 16 — Limitation of Liability
To the fullest extent permitted by applicable law, Menolae, its officers, directors, employees, affiliates, agents, contractors, licensors, and service providers — and those of Shopify and its affiliates — shall not be liable for any indirect, incidental, special, punitive, or consequential damages of any kind, including lost profits, lost revenue, loss of data, or replacement costs, arising from your use of our Services or any products purchased through them, even if advised of the possibility of such damages.
In no event shall Menolae's total aggregate liability to you for any claim exceed the total amount you paid for the specific product or service giving rise to the claim.
Important — Australian Consumers: Where liability cannot lawfully be excluded or limited under the Australian Consumer Law, our liability is limited to: (a) the replacement of goods or the supply of equivalent goods; (b) the repair of goods; or (c) the payment of the cost of replacing or repairing the goods — whichever is applicable and permitted by law.
Section 17 — Indemnification
You agree to indemnify, defend, and hold harmless Menolae, Shopify, and their respective affiliates, officers, directors, employees, agents, contractors, and licensors from and against any and all losses, liabilities, claims, damages, costs, and expenses (including reasonable legal fees) arising out of or relating to:
- Your breach of these Terms or any policy incorporated herein;
- Your violation of any applicable law or the rights of any third party;
- Your access to or use of our Services.
We will provide you with reasonable notice of any indemnifiable claim. We may, at our option, assume control of the defence and settlement of any such claim at your cost, provided we will not settle any claim imposing non-monetary obligations on you without your prior written consent.
Section 18 — Force Majeure
Menolae shall not be liable for any delay or failure to perform its obligations under these Terms where such delay or failure results from events beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemics, industrial action, government actions, or failures of telecommunications or internet infrastructure. Performance shall be suspended for the duration of such event and resumed as soon as reasonably practicable.
Section 19 — Dispute Resolution
In the event of any dispute, claim, or complaint arising from your use of our Services or any purchase, we strongly encourage you to contact us first at support@menolae.com to seek an informal resolution. We are committed to resolving all disputes fairly, promptly, and in good faith.
You agree to provide full cooperation and all relevant information to facilitate informal resolution before initiating any chargeback, formal complaint, or legal proceedings. Initiating a chargeback without first attempting resolution in good faith may be considered a breach of these Terms.
If a dispute cannot be resolved informally, it shall be subject to the governing law and jurisdiction set out in Section 21.
Menolae reserves the right to refuse future orders from any individual who engages in fraudulent, abusive, or bad-faith conduct in connection with a dispute.
Section 20 — Assignment
You may not assign, delegate, or transfer any rights or obligations under these Terms without our prior written consent. Any purported assignment without such consent shall be null and void. Menolae may freely assign, transfer, or delegate these Terms and any rights or obligations hereunder, without notice to you.
Section 21 — Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.
Notwithstanding the foregoing, where you are a consumer located in Australia, nothing in this clause shall deprive you of the protection afforded to you under the mandatory consumer protection provisions of Australian law, including the Australian Consumer Law. Australian consumers retain the right to pursue remedies through Australian courts and consumer protection bodies, including the ACCC, irrespective of this governing law clause.
Section 22 — Australian Consumer Law Notice
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these Terms excludes, restricts, or modifies any right, guarantee, or remedy available to Australian consumers under the Australian Consumer Law or any other applicable statute that cannot lawfully be excluded. If you are an Australian consumer and believe your statutory rights have not been upheld, you may contact the Australian Competition and Consumer Commission (ACCC) at www.accc.gov.au or your relevant state or territory consumer protection agency.
Section 23 — Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be severed from these Terms without affecting the validity and enforceability of the remaining provisions.
Section 24 — Waiver & Entire Agreement
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. These Terms, together with our Privacy Policy, Shipping Policy, and Refund, Returns & Warranty Policy, constitute the entire agreement between you and Menolae regarding your use of our Services and supersede all prior agreements, communications, and understandings.
Section 25 — Changes to These Terms
We reserve the right to update or modify these Terms at any time by publishing a revised version on our website. Material changes will be notified in accordance with applicable law. Your continued use of our Services following the posting of changes constitutes your acceptance of the revised Terms. We recommend reviewing this page periodically.
